Terms and Conditions

These terms and conditions (“Agreement”) set forth the general terms and conditions that govern the relationship between the Client (“you”, “your”) (referring to any purchaser and/or recipient of any goods or services from Holly Haywood / www.hollyhaywood.com, whether purchased or otherwise) and Holly Haywood (the “Company”, “we”, “I”, “my”, “us”, “our”). This Agreement is legally binding between you (“User”, “you” or “your”) and Holly Haywood (“Holly Haywood”, “we”, “us” or “our”). If you do not agree with the terms of this agreement, you must not accept this agreement and may not access or engage any services. By accessing my services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and Holly Haywood, even though it is electronic and is not physically signed by you, and it governs your use of Holly Haywood’s services now and in the future.

SESSIONS/PACKAGES

Every RTT session is unique, depending on the issue, the client, and what emerges within the session. Your RTT session will last approximately 2 hours, but may be shorter or longer, if time permits. We may then spend some time debriefing, so for this reason, you are asked to block out 2.5 hours in your calendar. 

BOOKING & PAYMENT

All professional fees will be disclosed prior to booking. Payment is generally made by credit card online at the time of booking. However, if you would prefer to pay via bank transfer, or would like to request a payment plan, please contact me so that we can arrange this.

ATTENDING YOUR SESSION

If you are running late for your session, please let me know as soon as possible via either text message or email. I will do my best to make a full session available, but this often depends on appointments subsequent to your booking and so cannot be guaranteed unfortunately. If your session needs to be curtailed due to your late arrival then the full session fee still applies.

Your RTT session will take place via Zoom, an easy and free-to-use software, unless arranged otherwise. Instructions for setting up Zoom will be sent prior to the session.

If you purchase an RTT 30-Day Transformation, you will first schedule in your Clarity Coaching Call. Once we have had this call, or prior, you will be invited to book in your RTT Session. My days of work are Wednesday, Thursday and Friday, and occasionally I may be available on weekends, however this is not guaranteed. I will do everything I can to accommodate your schedule and availabilities, however I cannot be held liable for session fees if you are unable to find a convenient time to attend your session/s or utilise any part of your RTT Package due to personal or other reasons. I will always work with you to attempt to reschedule a session, wherever possible. All sessions must be used within 60 days of payment. 

CANCELLATION, RESCHEDULING AND REFUNDS

Cancellation & Rescheduling

If you need to re-schedule a session/call, notification must be made by email or text message at least 48 hours prior to this. Any changes requested later than this will unfortunately attract a rebooking fee. Unless there are exceptional circumstances (at the discretion of the Company), a “no-show” will mean the session and/or session fee is forfeited.

The Company reserves the right to cancel an appointment at its sole discretion, however this will of course only be done in exceptional circumstances and as much notice as is possible will be given. Nonetheless, the Company shall not be held liable for any financial or other consequences of such a cancellation.

Refunds

No refunds are available once a session or package has been paid for. Session fees are for my time and professional expertise and are not a guarantee of a successful outcome. 

CONTACT BETWEEN SESSIONS

Contact between sessions will be available by email or text message during business hours (Monday-Friday, 9-6pm). While I will attempt to respond outside of these hours, it can’t be guaranteed (parenting duties!), and ultimately it should be expected that any messages received outside of my business hours will be dealt with during the next business day.

MEDICAL OR PSYCHOLOGICAL CONDITIONS

I may ask questions about your medical history to establish any contra-indications to treatment. This will also help to assess whether your health is affecting (or being affected by) the therapeutic goals you wish to achieve. 

By engaging my services, you understand that you are required to disclose all medical conditions, both past and present, to ensure the safety and appropriateness of our work together. Please update me with any medical changes that occur during the course of our work together.

If you are receiving care or treatment from any medical, healthcare or therapy practitioner, e.g. GP, Psychologist, Psychiatrist or Counsellor, you may be asked to seek their permission before any therapy sessions can commence.

CONTRAINDICATIONS

Hypnosis is contraindicated for epilepsy and conditions of psychosis, and therefore it is very important to note that I am unable to work with clients who have experienced either; whether presently or in the past. 

AGE RESTRICTIONS

You must be at least 18 years old to book a session. Clients under the age of 18 years would first need the written permission of their parent or guardian, although they would not be involved in the session or associated calls.

STANDARDS OF BEHAVIOUR

During the course of any therapy sessions, I will treat you with respect and not abuse the trust you place in me. I will use best practice at all times in our mutual interest. In return, you undertake not to harm yourself, or any other person, including me, or any property belonging to either me or any other person.

You agree not to attend sessions under the influence of alcohol or recreational drugs, except those medications which have been prescribed by your doctor. If you do attend any sessions under the influence of alcohol or recreational drugs, or demonstrate violent or abusive behaviour, I will cancel the session and may refuse to see you for any further sessions without refunding any payment already made.

OUTCOME OF SESSIONS 

Although clients have received great outcomes from Rapid Transformational Therapy (RTT) and the associated services being offered by the Company, results cannot be guaranteed and may vary based on the client’s specific set of circumstances, personal responsibility, participation and level of commitment. The agreement to work on the issues presented by the client in no way implies or guarantees the resolution of your presenting issue(s). No outcome can or will be guaranteed. However, in all cases I will endeavour to use my best efforts and skills to work towards your goals and intended outcomes.

FULL DISCLOSURE OF RELEVANT INFORMATION

All services are provided on the basis of the information provided by you. As part of this Agreement, you agree to provide full and complete information in respect to all questions asked in the Client Questionnaire and any other calls or sessions that are conducted during our work together, as well as offer all relevant background information. This is crucial to the success of the therapeutic process. If there are issues that you are not comfortable discussing, you are welcome to flag this ahead of time.

HYPNOTHERAPY RECORDINGS

Hypnotherapy recordings should not be listened to while driving, operating machinery, or undertaking any other activity where concentration is required. Any recording provided is for your personal use only and must not be shared, lent, copied, or sold under any circumstances.

PRIVACY & CONFIDENTIALITY

Data Protection

For my services, your personal data is collected, processed, used and stored in accordance with the following privacy policy: www.hollyhaywood.com/privacypolicy. By booking an appointment, you signify your acceptance of this Privacy Policy. If you do not agree to this policy, please do not book an appointment. The terms of this Privacy Policy may change from time to time without prior notice to you, so please check my website periodically for any changes.

Confidentiality

All contact, including sessions, telephone conversations and emails, will be conducted in full confidence. They may be recorded and prior to any recording, your agreement will be sought. All recordings, conversations and notes will remain completely confidential, except in cases where: 

  • The possibility of harm to yourself or others exists;

  • It is revealed that a child is being abused or is in danger of abuse;

  • I am compelled to reveal information by a court of law; or

  • I am, for any other reason, legally required to notify the authorities.

In all other cases, everything that is discussed within our sessions or during any communications will remain completely confidential and will never be shared with anyone, unless you expressly authorise this confidentiality to be broken for any reason.

In turn, you also understand and agree that all of our communications are to remain strictly confidential in respect to the integrity of my business services.

This includes:

  • Not recording in any way, or sharing, any communications (whether it be shared documents, written communication, audio communication or video call) the client has with the Company;

  • Not sharing any business materials or intellectual property belonging to the Company with anyone other than the Practitioner/Company.

 If a client breaks this confidentiality, they may be liable for legal action.

LIABILITY & INDEMNITY

The Company does not claim to and will not be held responsible for diagnosing, treating, or curing any physical or mental health condition. Our services should not be taken as being able to take the place of any health professional’s advice or expertise, and under no conditions should a client stop seeing his or her healthcare professionals as a result of engaging our services. The client understands that the Company is not providing professional healthcare services and is not serving as a professional healthcare provider.

Under no circumstances will Holly Haywood be liable for any damages, including without limitation, direct, indirect, incidental, special, punitive, consequential, or other damages (including without limitation lost profits, lost revenues, or similar economic loss), whether in contract, tort, or otherwise, arising out of the advice or information provided to you during professional services provided by Holly Haywood. In addition, you agree to defend, indemnify, and hold Holly Haywood harmless from and against any and all claims, losses, liabilities, damages and expenses (including legal fees) arising out of your participation in the professional services.

If a client decides to take action based on the coaching or therapy he or she receives from the Company, the client does so at his or her own risk. The Company is not and will not be held liable for any actions taken as a result of any suggestions or advice given by the Company.

GOVERNING LAW

These terms and conditions and any other matters arising out of or in relation to these terms, shall be governed by and construed in accordance with the laws of Australia. You agree to submit to the exclusive jurisdiction of the Australian courts to settle any dispute which may arise out of or in connection with these terms and conditions.

CHANGES & AMENDMENTS

These terms and conditions are subject to revisions without notice. Please familiarise yourself with any amendments if you have re-started therapy with me after a long period of absence.

ACCEPTANCE OF THESE TERMS

By booking a service with me, whether paid or otherwise, you are acknowledging that you have read this Agreement and agree to all its terms and conditions. If you do not agree to abide by the terms of this Agreement, please do not book a session or engage any other services via Holly Haywood or www.hollyhaywood.com
